The research aimed to verify whether questions oriented to the ninth year of Elementary Education of the Basic Education Assessment System – Saeb, address statistical content using problem solving according to the North American document Guidelines for Assessment and Instruction in Statistical Education (GAISE) - Report: a Pre-K-12 Curriculum Framework and the National Common Curricular Base - BNCC. For the presentation and analysis of the question: the type of reasoning used was described; it was analyzed according to problem resolution and variability according to the GAISE document; and finally, new questions focused on the use of problem solving for teaching statistics were suggested. Returning to questions from external and large-scale national assessments, in order to highlight the capabilities evidenced in them, it is noteworthy that those that make up the Saeb tests partially consider the process of problematizing and solving statistical problems, not addressing the statistical thinking that is the variability. It is considered that the statistical concepts and procedures to be worked on in elementary school statistics classes deserve an exploratory and investigative approach, being linked to the students' cultural and social contexts.
