LINGUISTIC RIGHTS AND ITS PERMEABILITY IN THE INTER-AMERICAN COMMISSION ON HUMAN RIGHTS

A productive study of Linguistic Rights requires, necessarily, a systemic knowledge of the protection policies of linguistic minorities that are developed and implemented by national States in contemporary times. It requires, on the other hand, a thorough analysis of the violations of the linguistic rights to which such minorities are subjected and which materialize, mainly, through the deliberate action and / or omission of those same States, to the detriment, mostly, of indigenous, migration, refugees communities and other groups whose languages do not even enjoy legal status in the juridical order of those countries in which they are located. The Inter-American Human Rights System, through the Inter-American Commission and the Inter-American Court of Human Rights, represents a supreme state body to which complaints of language rights violations against OAS member States can be addressed when these rights have a legal nature of human right. Seeking to understand the vision of linguistic human right with which the Inter-American Commission on Human Rights (IACHR) operates, this text will present some analyzes carried out in the set of 54 (fifty-for) admissibility reports that deal with linguistic issues, extracted from a database with a total of 2891 (two thousand and eight hundred ninety-one) cases submitted to the IACHR in the period between the years 1969 to 2019. The present study will also allow pointing out a significant set of related aspects the IACHR’s performance in the defense and protection of human linguistic rights, through the accurate identification of the most denounced countries, the linguistic groups with the highest number of reported violations, the nature of the most frequent violations (cultural, procedural, etc.) and when these violations represent the main or incidental object of the claim submitted to the IACHR.
