THE RIGHT TO ABORTION AND THE DIGNITY OF THE HUMAN PERSON IN THE ADPF NUMBER 442
Abstract
The article investigates the category constitutional person and the dimensions achieved by it in the Federal Supreme Court (STF). For this, an analysis is developed from the Action of Non-compliance with Fundamental Precept (ADPF) n. 442, filed by the Socialist and Freedom Party, in which the initial petition sustains the need to deepen the subject of the dignity of the human person. With method and comparative theory, an anthropological line is drawn from the symbolic and structural languages that the study requires. Therefore, the duty-of-law in its normative applicability (ADPF) is presented and discussed, in the face of the anthropological subjectivity of social relations from the perspective of Marshall Sahlins and Roy de Wagner.
